Terms of Service
Effective date: October 14, 2026. Last updated: October 14, 2026.
Agreement and scope
These Terms of Service govern Foster Love services at fosterlove.com, scholarships.fosterlove.com, checkout.fosterlove.com, my.fosterlove.com, and shop.fosterlove.com, and related account services and online tools that present or link to these Terms (the “Services”). The Services are operated by Together We Rise, doing business as Foster Love (“Foster Love,” “we,” “us,” or “our”).
You agree to these Terms when you affirmatively accept them through an account, program, or transaction process that presents them to you, or otherwise expressly agree to them. Completing a donation or payment alone does not constitute acceptance of these Terms when no Terms notice and acceptance mechanism are presented. If you do not agree, do not use a feature that requires acceptance. Applicable law and any additional terms presented for a particular program, event, donation, or purchase also apply. Our Privacy Policy explains our information practices; accepting these Terms does not waive your privacy rights.
Age eligibility and account attestation
You must be at least 13 years old to create or use a Foster Love account. By signing up for a Foster Love account, you represent and attest that you are 13 years of age or older. You must provide truthful age information when requested and must not misrepresent your age or help another person evade this requirement.
If you are 13 through 17 years old, or otherwise below the age of legal majority where you live, you may use an account only with the permission and appropriate supervision of a parent, legal guardian, or another adult or agency with actual legal authority to approve your participation in the particular activity. For youth in care, an authorized caregiver, social worker, or placing agency may provide that approval when it has the necessary authority; a role or job title alone does not establish authority. The authorized person must review these Terms with you and provide any required permission. Financial transactions and legally binding program commitments must satisfy the activity’s authorization requirements and applicable law. Contact Foster Love if you are unsure who can authorize your participation. Nothing in these Terms limits rights that applicable law gives to minors.
Children under 13 may not create or use their own Foster Love accounts, even with parental permission. A parent, legal guardian, or appropriately authorized adult may use the adult’s own account to inquire about or participate in eligible programs on a child’s behalf. Program participation may have different age requirements. This account restriction does not exclude children from receiving eligible program services through authorized adults.
Children’s information and underage accounts
The account Services are intended for users age 13 and older. Children under 13 must not submit their personal information to create an account. Foster Love does not knowingly collect personal information directly from children under 13 through account registration.
If we learn that an account belongs to a child under 13, we will restrict or disable that account, stop further collection through it, and take appropriate steps to delete personal information collected through the account, subject to applicable legal requirements. We will not treat an inaccurate age attestation as permission to continue collecting, using, or disclosing a child’s personal information.
A parent, guardian, or other person who believes a child under 13 has created an account or submitted personal information directly to the Services should contact us using the contact information below. Provide enough information to identify the account; do not send identity documents or additional sensitive information unless we request them through an appropriate verification process.
Adults providing information about children must have the necessary authority and permissions and must follow any program instructions, confidentiality obligations, court orders, and applicable law. Creating an account does not authorize publication of a child’s name, photograph, foster status, location, or other sensitive information. Any required media release or other specific consent must be obtained separately.
Account accuracy and security
Provide accurate registration information and keep it current. Protect your sign-in credentials and promptly notify us if you suspect unauthorized access. Do not impersonate another person, transfer an account without authorization, or access another person’s account without permission. If you act for an organization, you must have authority to act for that organization.
We may request information reasonably necessary to verify eligibility, authority, or account security. We may restrict access while resolving a security or eligibility concern. You are responsible for activity you authorize through your account, subject to rights and protections under applicable law.
Acceptable use
Use the Services lawfully and respectfully. You must not:
- Submit fraudulent applications, misleading fundraising claims, false identity information, or payment information you are not authorized to use.
- Harass, threaten, exploit, or discriminate against others, or post unlawful or sexually exploitative material.
- Disclose confidential case records, identifying information about children in care, or someone else’s personal information without appropriate authorization.
- Infringe intellectual property, privacy, publicity, or other rights.
- Introduce malicious software, bypass security controls, disrupt the Services, or obtain data through unauthorized access.
- Use Foster Love’s name, branding, or Services to suggest an endorsement, partnership, or fundraising authorization that we have not granted.
We may remove content or restrict activity that violates these Terms or threatens the safety or integrity of the Services.
Donations, payments, and recurring contributions
You must be authorized to use the payment method you provide. Review the amount, frequency, fees, and any transaction terms presented before submitting a donation or purchase. A recurring contribution requires your separate authorization of the amount and billing frequency disclosed at checkout. Accepting these Terms alone does not authorize recurring charges.
Cancellation instructions and any applicable donation, purchase, refund, or shipping terms will be provided with the relevant transaction or service. Contact Foster Love if you need help stopping future recurring contributions or correcting a transaction. Nothing in these Terms limits legally required refunds, cancellation rights, or payment dispute rights.
The Foster Love Shop at shop.fosterlove.com operates through Shopify. Shop purchases are subject to the Shop’s purchase terms and refund policy, including applicable provisions on orders, payments, shipping, returns, refunds, and purchase eligibility. Those purchase-specific provisions apply to Shop transactions; these Terms otherwise govern general use of Foster Love’s Services, including the Shop. If purchase-specific provisions conflict with these Terms on a purchase matter, the purchase-specific provisions control that matter, subject to applicable law. The 13-or-older account threshold does not override any purchase eligibility or authorization requirement. Our Privacy Policy covers Foster Love’s handling of Shop information; Shopify and other providers may also process information under their own privacy notices.
Descriptions of tax deductibility are general information. Your circumstances and any goods or benefits received may affect deductibility; consult your tax adviser. We do not guarantee that a particular donation or purchase is deductible in full.
Program applications and fundraising
Creating an account or submitting an application does not guarantee eligibility, funding, admission, a scholarship, a placement, or any other program benefit. Each program’s stated eligibility requirements, available resources, and applicable terms govern participation. Separate program agreements and releases govern the activities they expressly cover.
If you create a fundraising page, provide accurate information, respect the privacy and dignity of beneficiaries, and follow the fundraising instructions presented to you. Do not promise benefits or use of funds that Foster Love has not authorized. Specific restrictions accepted by Foster Love in writing remain subject to the applicable donation agreement.
Donations made through Foster Love fundraising pages are received by Together We Rise dba Foster Love. Campaign organizers do not receive or control those donation proceeds through the fundraising platform and do not act as Foster Love’s agents or representatives merely by creating a page. Organizers may not make commitments on Foster Love’s behalf.
Do not conduct raffles, sweepstakes, or other prize promotions using Foster Love’s name or fundraising pages without our prior written approval and compliance with all applicable legal requirements. A business promoting donations based on its sales must have a written agreement with Foster Love before advertising that arrangement. Our approval does not replace any registration, authorization, or other requirement imposed by law.
Content ownership and permissions
Foster Love and its licensors own the Services’ design, software, trademarks, and original content. You may use the Services for their intended purposes. Other use of our branding or protected content requires permission or another lawful basis.
You retain ownership of content you submit. You grant Foster Love a nonexclusive license to host, reproduce, display, and process that content as reasonably necessary to provide the feature or program for which you submitted it. This license does not authorize unrelated publicity use of private account information, applications, or sensitive information about children. Promotional use requiring a release is governed by that separate release and applicable law.
You must have the rights and permissions necessary to submit your content. We may remove content to comply with law, protect privacy or safety, or enforce these Terms. Any content license remains subject to applicable privacy and deletion rights.
Privacy, communications, and California minors
The Privacy Policy explains collection, use, disclosure, and available privacy choices. These Terms do not provide blanket consent to sell or share personal information, conduct targeted advertising, send marketing texts, or make automated marketing calls. Where separate consent is required, it must be obtained separately. Account creation is not a substitute for any required parental consent.
California residents under 18 who are registered users may request removal of content or information they personally posted to the Services by contacting Foster Love. Identify your account, the content or its location, and that you are requesting removal as a California minor. Do not include unnecessary sensitive information. We may reasonably verify the request. Removal may not eliminate copies reposted by others or retained as permitted or required by law, and legal exceptions may apply. We will process requests in accordance with applicable law.
Nothing in these Terms waives protections provided by the federal Children’s Online Privacy Protection Act (COPPA), California privacy laws, or other applicable laws. Where California law requires affirmative authorization for the sale or sharing of a known minor’s personal information, accepting these Terms or attesting to being 13 or older does not supply that authorization.
Third-party services
The Services may link to third-party websites or use third-party payment and other tools. Third parties may have their own terms and privacy notices. A link does not imply endorsement. We are not responsible for third-party content or conduct except to the extent applicable law imposes responsibility on us.
Service availability and disclaimers
We may change, interrupt, or discontinue features, subject to existing commitments and applicable law. The Services are provided “as is” and “as available.” To the extent permitted by law, Foster Love disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted access or that all content will be error free.
Website information is general information and does not substitute for individualized legal, medical, financial, or professional advice. The Services are not an emergency response service.
Limits on liability
To the extent permitted by applicable law, Foster Love and its directors, officers, employees, volunteers, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services. This limitation does not exclude liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or other conduct for which the law prohibits a limitation. Mandatory consumer rights and minors’ statutory rights remain intact.
Suspension, account closure, and retained obligations
We may suspend or close accounts for material violations of these Terms, fraud, security risks, or failure to meet age or program eligibility requirements. When appropriate, we will provide notice and an opportunity to resolve the concern; immediate action may be necessary to protect children, prevent harm, or comply with law.
You may request account closure through the contact information below. Closure does not automatically cancel a separately authorized recurring contribution; use its cancellation instructions or contact us for assistance. Account closure and data deletion are handled under the Privacy Policy and applicable retention requirements. Outstanding lawful payment obligations and provisions intended to survive closure remain applicable.
Changes, governing law, and general provisions
We will publish revised Terms with an effective date and notify account holders of material changes through the Services, email, or another appropriate channel. The notice will explain when the changes take effect and how to accept them. We provide notice before material changes take effect when reasonably practicable; legal or urgent security needs may require earlier changes.
For existing account holders, revised Terms apply through renewed affirmative acceptance where required. Continued use after a stated effective date applies revised Terms only where legally permitted and where the notice clearly explains that consequence. If you do not agree, stop using the affected Services and request account closure. Changes do not retroactively remove accrued rights. Continued use is not a substitute for separate privacy, marketing, parental, or other consent required by law.
California law governs these Terms, except where applicable law requires otherwise. Nothing in these Terms deprives you of mandatory protections or an available forum provided by the law where you live. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These Terms and the additional terms expressly applicable to a particular activity govern that activity.
